By using this website, contacting us, placing an order, or opting in to our email or text message programs, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use this site or our services. You must be 18 or older to order or to sign up for our messages.
Text messaging terms
Pavement Depot text message program. Pavement Depot sends text messages to customers who opt in. By giving us your mobile number and opting in, you consent to receive text (SMS) and multimedia (MMS) messages from us at that number, including messages sent using automated technology.
Types of messages you will receive. Depending on the consent you give us, you may receive:
- Customer care and order messages: order confirmations, back-order and stock updates, shipping and tracking notices, pickup and bulk-fill ready notices, appointment confirmations, quote follow-ups, and replies to questions you send us.
- Promotional messages: sales and seasonal promotions, new product availability, and invitations to our free training days.
Message frequency varies.
Message and data rates may apply. Any charges come from your mobile carrier and are your responsibility.
Reply HELP for help, or STOP to opt out. You can opt out at any time by replying STOP to any message. You will get one confirmation message and then nothing further unless you opt back in. You can also opt out by calling 1-866-595-2308 or emailing info@pavementdepot.ca.
Carriers are not liable for delayed or undelivered messages. Delivery depends on your mobile carrier’s network and is not guaranteed. Not all carriers or devices are supported.
Consent to receive text messages is not a condition of purchasing anything from us. Please tell us if you change or give up the mobile number you signed up with. Your number and consent are handled as described in our Privacy Policy, and are never shared with third parties for marketing.
If you sign up for our emails, you will receive product news, promotions, seasonal information, and training invitations. Every marketing email has an unsubscribe link, and we action requests within 10 business days. Emails about an order you placed will continue.
Pricing, products, and availability
Product descriptions, specifications, images, and stock information are provided in good faith but may contain errors or become out of date, and manufacturers can change specifications without notice. Prices are in Canadian dollars and subject to change. Quotes are valid for 30 days unless stated otherwise, and are subject to availability. We reserve the right to correct errors and to refuse, limit, or cancel any order. If we cancel an order you have paid for, we refund it in full. Bulk sealer and material availability is seasonal.
Orders, shipping, and pickup
Orders are placed by phone, email, in person, or through a quote request on this site, and are accepted once we confirm them. Taxes, shipping, freight, and handling are added at invoicing. Tax-exempt status requires valid documentation before invoicing. We ship across Canada and offer pickup at both locations. Shipping timelines are estimates, not guarantees. Please inspect shipments on arrival and report damage or shortages to us and the carrier right away.
Returns and warranty
Return eligibility, restocking fees, and the return window are set out in our return policy and on your invoice. [REPLACE WITH YOUR ACTUAL RETURN TERMS.] Custom, special-order, opened, mixed, or hazardous goods, including sealer, paint, and crack filler, are generally non-returnable.
Equipment is covered by the manufacturer’s warranty. We will help you make a claim, but we do not provide any warranty beyond the manufacturer’s unless we agree to one in writing. Warranty does not cover normal wear, consumables, improper use, poor maintenance, unauthorized modification, or damage from incompatible materials.
Safety and proper use
The equipment and materials we sell, including hot-applied crack sealers, melter kettles, sealers, solvent-based paints, sprayers, blowers, and infrared heaters, can cause serious injury, burns, fire, or death if used improperly. You are responsible for reading and following all manufacturer manuals, warnings, and Safety Data Sheets, using proper protective equipment, and complying with all workplace safety, transportation, environmental, and municipal rules, including any local restrictions on specific sealer products. Safety Data Sheets are on our website and available on request.
Training and advice
Our free training, coaching, blog posts, videos, and advice are general education only. They are not professional, engineering, legal, or financial advice, and results vary with your equipment, conditions, skill, and market. You are responsible for the decisions you make about your own business and job sites.
Website content and your submissions
All content on this site, including text, product descriptions, photographs, graphics, videos, logos, and the Pavement Depot name, is owned by us or our suppliers. You may view and print it for your own non-commercial use, but not republish, resell, or use it commercially without our written permission. Third-party brand names and logos belong to their owners.
If you send us a review, photo, or testimonial, you give us permission to use and display it in connection with our business, and you confirm it is yours to share.
You agree not to use this website to break any law, transmit malware, scrape data, or interfere with how the site works.
Third-party links and financing
Our site links to manufacturers, safety data sheets, financing providers, and social media platforms. We do not control those third parties and are not responsible for their content, products, or terms. Any equipment financing is a separate agreement between you and the provider, who sets all approvals, rates, and terms.
Disclaimers and limitation of liability
Except as stated in these terms or required by law, this website and its content are provided “as is,” without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted or error-free.
To the maximum extent permitted by law, Pavement Depot and its owners, employees, and agents are not liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, business, or data, arising from your use of this website, our products, our training content, or our messaging programs. Our total liability for any claim relating to a product or order will not exceed what you paid us for it.
Nothing in these terms limits your rights under applicable consumer protection law.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario. If any part of these terms is found unenforceable, the rest stays in effect.
Changes to these terms
We may update these terms at any time. The current version is always posted at https://pavementdepot.ca/terms-of-service/ with the effective date at the top. Continued use of the site or our messaging programs after changes are posted means you accept them.
